Online grocery buying Terms and Conditions

These are the terms and conditions which apply when buying goods from our grocery service. Please read this agreement carefully. This should be read in combination with the 'Use of Website' terms and conditions and our Privacy Policy. These represent the Terms and Conditions for using this service. If you do not agree to these, then you may not use this Website.

You are permitted to use our Website solely on the basis of these Terms and Conditions. We reserve the right, at our discretion, to update and/or revise these Terms and Conditions. Please check periodically for changes.

1. Fruit, Veg and Egg registration and contract

1.1 Happyhensuk.com means Happyhens. You are the customer. You agree to purchase services and goods from happyhens subject to these Terms and Conditions which will apply to all transactions using our service.

1.2 You must be 18 years or over and must complete the registration procedure to participate in our service.

1.3 By registering for this service you agree that the details provided by you on registration, or at any time, are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You must give us your real name, address, phone number, email address and any other details that we may require to process your order.

1.4 Your email address is essential in order for us to be able to supply you with important information such as order confirmations, and changes to the service. By registering with our grocery service, you accept that your email address may be used to supply you with such information.

1.5 It is your responsibility to keep your password secure. We reserve the right to modify or withdraw a password at our discretion.

1.6 We reserve the right to:

• Decline a new customer registration or suspend or terminate a customer's account at any time and at our sole discretion.
• At our absolute discretion to terminate your access to all or part of this service with or without notice.

1.7 The contract between you and Happyhens is concluded on delivery.

1.8 We will not be responsible for any loss or damage caused to the goods after the contract has been concluded. Otherwise, our liability to you shall be limited in contract and/or tort to the value of the order only.

2. Grocery pricing and payment

2.1 The prices shown on this Website at the time of ordering are guide prices. .You accept that prices of goods may, therefore, increase or decrease between the day of ordering and the day of delivery.

Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. If a product's correct price is higher than the price stated on our site, we are under no obligation to supply the product to you at this price and will inform you as soon as possible to give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.

2.2 The weight of some goods may vary marginally from that ordered and the price may change to reflect actual weight - if it weighs a little less you pay a little less and if it weighs a little more you pay a little more. Prices in 'My trolley' are estimates only.

2.3 Payment will be taken on point of order if paid online, other methods are available. Methods of payment are described in 'payment methods' within the 'help' section of this Website.

3. Supply of grocery goods ordered and alternative goods

3.1 Goods will not be supplied for the purposes of resale, and are only supplied for your own use as a consumer. We reserve the right to refuse orders that we consider are for commercial or non-domestic purposes, or subject to onward delivery by a 3rd party.

3.3 Goods are subject to availability and prevailing market conditions, If any goods you wish to purchase are not available, Happyhens may try to offer you 'alternative goods' similar to the goods you have requested, which may be a different price. Please note we will attempt to deliver substitute products should selected products be unavailable unless you request us not to do so.

3.4 We will tell you which items have been substituted and with what. You do not have to accept the alternative goods offered by Happyhens. Acceptance or rejection of any alternative goods does not occur until you have the opportunity to inspect them at the time of delivery. Where alternative products are accepted, customers should check product packaging for the most up to date nutritional information and allergen warnings, as these may differ from the products originally ordered.

4. Ordering of multiple or bulky grocery items

4.1 Orders for more than 12 units of a single product line may be fulfilled subject to availability and at the discretion of the store. Quantities of goods supplied per order may be limited if the order limits availability for other customers or creates a potential health and safety issue for our drivers. To ensure we have the greatest opportunity of fulfilling larger orders, please give us at least 7 days notice of your request.

4.2 Due to concerns regarding the heath and safety, we reserve the right to limit orders of certain bulky items, such as bottled water.

5. Placing a grocery order

5.1 There is a £10 minimum order value on any grocery order.

5.2 Happyhens reserve the right to amend delivery fees at any time without notice. Although delivery is not charged at present, customers may request delivery out of area/rounds or order criteria in order to facilitate delivery, charges on application.

6. Amending or cancelling an grocery order

6.1 Changes to your order may be made up until 5pm on the day before delivery. Orders can only be cancelled by email and any refund will be subject to a £5.00 deduction for processing.

6.2 Should adverse weather conditions or any other event outside our reasonable control result in a later or cancelled delivery, we will contact you as soon as possible to re-schedule your delivery. Should you incur any loss as a direct result of such a delay our liability to you shall be limited to the value of the order only.

8. Grocery delivery restrictions

8.1 We will deliver to the address specified by you when you checkout your order.

8.2 We reserve the right to restrict or refuse delivery requests in certain areas at any time and without notice.

9. Our grocery doorstep service

9.1 We will always deliver your order to the front door of your house or to the communal entrance to your block of flats. We may also deliver beyond this into your home. Please see our 'providing a safe delivery' section in our Delivery information section for further details.

9.2 If your delivery is to a work address, we will always deliver to the ground floor communal entrance of your business' building then contact you to meet our driver. We reserve the right to return your order to our store if you do not come to collect your order within a reasonable time. In this instance, we reserve the right to charge for any re-delivery. Please see re-delivery below.

10. Grocery re-delivery

10.1 If you are out for the time of your scheduled delivery, or are unable to meet our driver in your workplace within a reasonable time, we reserve the right to return your order and may charge for redelivery.

10.2 If you have not contacted us on 01273 703727 or by email within 24 hours to rearrange a failed delivery, the order may be cancelled and held in credit or refunded (less £5.00 admin fee) and we may retain any delivery fee if applicable.

11. Grocery returns

11.1 If whilst inspecting the goods at the time of delivery, you identify goods you do not want, you are free to decline any product delivered by your driver for any reason (including the price on delivery). You can return them to the driver and ask him or her to take them away.

11.2 Any goods you return to our driver will be automatically credited to your account. If refunded to the credit or debit card used to make the payment this will be shown as a refund on the next payment card statement. Refunds take up to 10 working days to reach your account.

11.3 After the driver has left, you have the right to return goods and/or faulty goods in line Happyhens returns policy. Goods not returned to our driver at the time of delivery should be returned at your expense. in original packaging in saleable condition.
Please note, it is not possible to return perishable food and drink unless they are of poor quality or faulty, or where we have delivered goods that you did not order and you have not accepted them.

12.2 If we communicate with you by telephone, please note that some telephone calls may be recorded for training and security purposes.

13. Grocery privacy and general provisions

13.1 Your personal details may be used only by Happyhens for market research and statistical analysis. We would also like to contact you occasionally with details of products, services and special offers that may interest you. Happyhens may use your mobile phone number (if you have provided one) or email for contact. Happyhens will always keep your data in accordance with the Data Protection Act 1998 and will only use your mobile phone number to contact you about your shopping order.

13.2 These Terms and Conditions and the documents produced in accordance with it comprise the entire agreement between you and Happyhens regarding each grocery order which concludes in a contract. English law is the governing law of each contract.

13.3 Happyhens reserve the right to alter or withdraw the grocery service at any time, to refuse the service to any customer and to amend these Terms and Conditions of this Website. If we make any changes to these terms, we will let you know as soon a possible by posting the changes on our Website and updating the date below.

13.4 We suggest that you print off a copy of these Terms and Conditions for your future reference.
